Membership Policy Terms and Conditions for Membership to UberDate.com UberDate.com requires that all members be at least 18 years of age. Access to profiles and use of UberDate.com is limited to those members who are at least 18 years of age. Access to profiles or use of UberDate.com by any person under the age of 18 is prohibited. Please read the following Terms and Conditions for Membership (this "Agreement") carefully. By registering with this Service you become a member (a "Member") and you agree that your membership is bound by this Agreement. If you do not agree to the terms of this Agreement, you are kindly asked not to register with the Web site or to access the Web site. The contents of this Agreement may be modified or changed at the discretion of UberDate.com. The Web site as represented to you upon registering and becoming a Member may be changed or modified. Fees for the Web site are subject to change, but only at the expiration of a term already paid for by a Member. By registering, becoming a Member, and using the Web site, you represent and warrant that you have the right, authority and capacity to enter into this Agreement, and that you are at least 18 years of age. When registering to become a Member, you agree to provide current, accurate and complete information. The Web site reserves the right to terminate a Member who does not provide current, accurate and complete information. It is required that a Member be at least 18 years of age. However, the Web site does not guarantee that each member is at least 18 years of age and the Web site does not accept responsibility or liability for any content, communication or use of this Service by any person under the age of 18. By registering and becoming a Member of the Web site, you agree that you will not impersonate another person, or stalk or harass any other person. A Member is solely responsible for interaction with other users of this Service, and UberDate.com reserves the right to monitor communication on the Web site, but makes no warranty to resolve disputes. You will not post on this Service any defamatory, pornographic, racially offensive, threatening, harassing, or otherwise profane material. Spamming, junk mail and chain letters are prohibited. You will not imply that the Web site in any way endorses any statements that you make. You will not in any way disrupt the functioning of this Service or the servers and networks associated with the Web site. You will not post, email or transmit any material that contains software viruses or any data that will disrupt the functionality of this Service. You will not modify, copy, frame, mirror or otherwise disassemble any part of the Web site without the prior consent of UberDate.com. UberDate.com is not responsible for any personal information a member decides to disclose through the use of this Service - see the privacy policy. Personal contact information, which includes phone number, email address, web site URL, last name, and street address, is prohibited on a Member profile. You agree to indemnify and hold UberDate.com, its owners, parents, subsidiaries, affiliates, officers, directors, employees and agents harmless from any loss, liability, claim, costs, damages or other expenses, including reasonable attorney's fees, that arise, directly or indirectly, from 1) your use of this Service and the Web site 2) your breach of this Agreement and 3) any allegation from a third party that the materials you submit violate copyright, trademark, trade secrets or other intellectual property of a third party. In no event shall UberDate.com be liable to you or any third party or person for any direct, indirect, consequential, exemplary, incidental or punitive damages. The liability of UberDate.com to you, for any cause whatsoever, will at all times be limited to the amount paid to become a Member, if any. As a Member you are solely responsible for maintaining the confidentiality of your username and password and for any and all activities that are conducted through your account. You are solely responsible for cancelling an upgraded membership through www.ccbill.com. The ccBill membership calls for monthly "recurring" billing, per your agreement with ccBill and their Terms and Conditions, and UberDate.com takes no responsibility for the Member not cancelling his or her membership as prescribed by this agreement and ccBill's Terms and Conditions. Member is solely responsible for cancelling the recurring membership he or she agreed to. UberDate.com does not exclude any liability for death or personal injury due to our negligence. The Web site and this Service are provided "as-is" and UberDate.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. UberDate.com does not promise any specific results from the use of the Web site. Upon the decision by a Member to cancel membership, Member is soley responsible for deleting his or her profile, and an upgraded Member is solely responsible for cancelling billing with ccBill. Both of these functions can be performed on the "My Account" page of the Member profile. FREE LIFETIME MEMBERSHIP GUARANTEE: If, after two full billing cycles (61 days) you have not met the person you are looking for, UberDate.com will provide you with a FREE lifetime Membership. No reason is needed to apply for your lifetime Membership - just that you have completed two billing cycles and made those two payments (often less in cost than the price of one month with other online dating sites). To receive your free lifetime Membership you must send an email to UberDate.com through the "Contact Us" section found at the top right of each page AFTER your second FULL month as a paid Member (you are billed on 30 day cycles and may ask for your free lifetime Membership anytime after day 61), and this email MUST include your username AND the email address you signed up with, along with a simple request to receive your free lifetime Membership. This will automatically suspend your billing forever, yet you will still have full Membership privileges for free and forever, including being able to email as many Members as you wish for free. If you fail to send the above referenced email with the above referenced information, your free lifetime Membership will not take affect until you do so. UberDate.com owns and retains the proprietary rights to this Service and the Web site. The Service and the Web site contain the copyrighted material, trademarks and other proprietary information of UberDate.com. A Member may not post, distribute or reproduce any copyrighted material, trademarks or other such proprietary information without obtaining the prior written consent of the owner of such proprietary rights. UberDate.com will respect your personal information and undertake to comply with all applicable data protection laws in the United States, as stated in the privacy policy. This Agreement
shall remain in full force while you use the Web site, have a profile posted on the Web site and are a
Member. Pennsylvania (U.S.) State law governs this Agreement, as
set forth in these Terms and Conditions for Membership, and this
Agreement shall not be governed by the United Nations Convention
on Contracts for the International Sale of Goods. This Agreement
shall terminate immediately, nullifying your membership, if you
breach any of the Terms and Conditions for Membership here in, subject
to the survival of all rights and reservations of UberDate.com. Member
has read and agrees to the Terms and Conditions for Membership to |
